OVERVIEW
Welcome to Warmaly. The terms "we," "us" and "our" refer to Warmaly. Warmaly operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Warmaly is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they include important information about your legal rights. By visiting, using or purchasing from the Services, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree to these Terms, please do not use or access the Services.
1. ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence. You are responsible for keeping any account password and login details confidential, and for all activity that occurs under your account. We may refuse service, close accounts or cancel orders at our discretion, including where we suspect fraud or misuse.
2. OUR PRODUCTS
We aim to describe and display our products as accurately as possible, including colors, features, heating zones and sizing. Colors may look slightly different depending on your screen, and product images are for illustration. Warmth, heat-up time and run time depend on the heat level you choose, the power bank you use, the outside temperature and how the jacket is worn.
Please check the size chart on the product page before ordering. If you are unsure about your size, contact us at support@warmaly.com before you buy.
3. PRICES, BUNDLES AND FREE GIFTS
All prices are shown in U.S. dollars. Prices, bundles and promotions may change at any time without notice, but a change will not affect an order we have already confirmed.
Some offers include free gifts, such as winter gloves, when you buy a qualifying number of jackets. Free gifts:
- are tied to the qualifying jackets in the same order and have no cash value;
- are added or removed automatically if the number of qualifying jackets in your cart changes;
- cannot be ordered on their own or exchanged for cash or store credit;
- are subject to availability, and we may substitute an item of equal or greater value.
If you return a jacket that qualified for a free gift, the free gift that came with it must be returned as well. If it is not returned, we may deduct its regular retail price from your refund.
We may cancel or adjust orders that use an offer in a way that does not match its terms, including orders placed by altering the cart or checkout to obtain free gifts or discounts that were not earned.
4. ORDERS AND PAYMENT
Placing an order is an offer to buy. We may accept or decline any order, limit quantities per person, household or order, and cancel orders that appear to be placed by resellers or that show signs of fraud. If we cancel an order after you have been charged, we will refund the amount charged to your original payment method.
You agree to provide current, complete and accurate purchase and account information, and to update it promptly if anything changes, so that we can complete your transactions and contact you as needed. Payments are processed securely through Shopify and our payment providers.
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct these errors and to change or update information, or cancel orders, if any information is inaccurate, at any time without prior notice (including after you have submitted your order).
5. SHIPPING AND DELIVERY
Shipping times, costs, tracking and what to do about lost or damaged packages are explained in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Risk of loss passes to you when the package is handed to the carrier.
6. RETURNS AND REFUNDS
Returns, exchanges and refunds are handled under our Refund Policy, which forms part of these Terms. Please read it before you buy.
7. SAFE USE OF HEATED APPAREL AND POWER BANKS
Our jackets are heated by a USB power bank. To use them safely:
- Follow the instructions supplied with the product.
- Use only a power bank that meets the specifications we recommend, and do not use a damaged power bank or cable.
- Do not wear the jacket with the heat on while sleeping, and do not leave heated apparel switched on unattended.
- Heated apparel is not intended for young children, or for anyone who cannot feel heat normally, adjust the heat level or switch it off by themselves.
- Stop using the heat and remove the power bank if you feel discomfort or the jacket becomes too hot.
- Remove the power bank before washing, and wash and dry the jacket only as shown on the care label.
- Do not modify, open or repair the heating elements, cables or power bank.
Using the products in a way that does not follow these instructions may cause damage or injury, and may affect your return or warranty rights.
8. REVIEWS, COMMENTS AND FEEDBACK
If you send us reviews, photos, comments, ideas or other feedback, you allow us to use, publish, edit and display them in connection with the Services and our marketing, without payment to you. You confirm that your content is truthful, that you have the right to share it, and that it does not contain anything unlawful, abusive, misleading or infringing. We may remove any content at our discretion. We publish customer reviews as received and do not edit them to change their meaning.
9. INTELLECTUAL PROPERTY
The Services and all content on them, including text, images, videos, designs, logos and the Warmaly name, are owned by us or our licensors and are protected by copyright, trademark and other laws. You may not copy, reproduce, sell or use any part of the Services for commercial purposes without our written permission.
10. THIRD-PARTY LINKS AND TOOLS
The Services may include links to, or tools provided by, third parties (for example payment, shipping or review providers). We do not control and are not responsible for third-party websites or tools, and your use of them is at your own risk and subject to their own terms and policies.
11. PROHIBITED USES
You may not use the Services: (a) for any unlawful purpose; (b) to violate any laws or the rights of others; (c) to harass, abuse, defame or discriminate against anyone; (d) to submit false or misleading information; (e) to upload viruses or any other malicious code; (f) to collect or track the personal information of others; (g) to spam, phish, scrape or crawl; (h) to interfere with or get around the security features of the Services, including the cart and checkout; or (i) to resell our products without our written permission. We may suspend or end your access to the Services for violating any of these prohibited uses.
12. DISCLAIMER OF WARRANTIES
Except as expressly stated in these Terms or our Refund Policy, and to the fullest extent permitted by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be waived.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Warmaly and its owners, employees, affiliates and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue, savings or data, arising from your use of the Services or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some states do not allow certain limitations of liability, so some of these limitations may not apply to you.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Warmaly and its owners, employees, affiliates and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
15. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles. Before starting any formal claim, please contact us at support@warmaly.com so we can try to resolve the issue informally.
16. SEVERABILITY AND ENTIRE AGREEMENT
If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Services. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version will always be posted on this page with the "Last updated" date. Your continued use of the Services after changes are posted means you accept the updated Terms.
